Powers of Attorney

A power of attorney is a formal method of creating relationship under which one person has the ability to permanently or temporarily act in the place of another. While the name may suggest that you must be an attorney to assume such a relationship, this is not the case. Any competent individual may be a power of attorney for someone else.

At Rech Law, our estate planning attorneys in Charlotte can prepare three types of powers of attorney for your needs:

  • Healthcare Power of Attorney: A healthcare power of attorney is a legal document that typically works in concurrence with a living will. By executing a healthcare power of attorney you are authorizing another to make medical decisions for you should you be unable to make those decisions for yourself. We recommend that when designating someone to be your healthcare power attorney, or healthcare agent, that you not only choose someone close to you whom you trust but that you also discuss with them your wishes in the event of your incapacitation.
  • Durable Power of Attorney: Also known as a financial power of attorney, a durable power of attorney is a legal document that allows another person to make financial decisions on your behalf. Having a durable power of attorney is important because without one and in the event of your incapacitation the Court would need to appoint a guardian to handle your finances. This can be hard and costly for a family to bear.
  • Parental Power of Attorney: If the parent or parents of a minor are unable to care for the child as a result of serious illness, military deployment, or being unavailable for a period of time. This allows for the person granted power, usually a close relative, to make specific decisions regarding the minor’s healthcare, schooling, and other activities.
