We can help with all North Carolina divorce matters, including:

Our North Carolina family law firm proudly offers residents across Union County comprehensive divorce services. We know that every family is different and, therefore, every case is unique. With this in mind, we work hard to provide the legal services that you need to feel assured and supported.

Many people beginning the divorce process are unsure where to start, how to protect their finances, or how their time with their children might be affected, and these are issues we address directly during an initial consultation. We talk through practical steps such as gathering financial documents, communicating with your spouse, and planning for temporary living arrangements in or around Monroe and neighboring communities. By giving clear guidance early on, a divorce lawyer from our team can help you avoid common missteps that might harm your long-term interests.

Understanding Divorce in North Carolina

If one or both spouses want to end the marriage, either may file for divorce. In North Carolina, you are not required to have specific "grounds" to file for divorce. However, the couple does need to meet certain requirements to qualify for a North Carolina divorce.

According to North Carolina G.S. 50-6, a couple must meet all of the following requirements:

  • The parties must have lived apart (in separate residences) for at least one year
  • At least one of the spouses must have been a NC resident for six or more months

In North Carolina, there are two types of divorce: contested and uncontested.

  • A contested divorce occurs when the divorcing parties cannot agree on one or more aspects of their divorce. In these cases, unless the parties later agree, they will have to litigate the contested matters in court.
  • Uncontested divorces can be achieved when both parties agree on all of the particulars of their divorce settlement, such as spousal maintenance, property division, etc. If you and your spouse initially file for a contested divorce but resolve your disputes after filing, you may resolve your case without the need to go to court.

We are sometimes asked if it matters who files for divorce (no, it does not) and whether you have to have the consent of your spouse to obtain a divorce (no, you do not). In fact, your spouse does not even need to sign divorce paperwork or show up to litigate in court. However, you must serve your spouse the appropriate legal documents that you have filed for divorce.

Beyond the basic requirements, many people want to know how issues like child custody, child support, and equitable distribution of property are handled under North Carolina law. These matters are typically addressed either through a separation agreement negotiated between the parties or through court orders issued by a judge in Union County if you cannot agree. A divorce lawyer from our firm can explain how state statutes and local court procedures may apply to your specific situation so you can make informed decisions about settlement versus litigation.

Preparing For Your Divorce Consultation

Meeting with an attorney for the first time can feel overwhelming, especially when you are already dealing with the stress of a failing marriage. Taking a few simple steps before your consultation can help you make the most of your time and leave with clearer answers about your rights and options. We encourage Monroe and Union County residents to view this meeting as a chance to ask questions, gather information, and decide whether our firm is the right fit for their needs.

It is helpful to bring basic financial documents, such as recent pay stubs, tax returns, mortgage statements, and information about major assets and debts, so we can begin to understand your financial picture. If there are children involved, information about their current schedules, school arrangements, and any special needs can also inform our discussion. During the consultation, we will ask about your priorities and concerns, explain how the Union County Judicial Center typically handles cases like yours, and outline potential next steps if you choose to move forward with a divorce attorney from our team.
