Contesting a Will in North Carolina

North Carolina uses a specific procedure to challenge a will’s validity called a caveat proceeding. A caveat is filed with the Clerk of Superior Court and must generally be filed within three years of the will’s admission to probate. Once filed, North Carolina law transfers the matter out of the Clerk’s jurisdiction and into Superior Court, where a jury decides the will’s validity in a proceeding known as devisavit vel non, a Latin phrase meaning “he devised or not,” referring to whether the disputed document truly represents the decedent’s wishes.

Where Charlotte Estate Cases Are Filed

Routine estate administration in Mecklenburg County runs through the Clerk of Superior Court’s Estates Division at the Mecklenburg County Courthouse. The Clerk, acting as probate judge, handles most estate hearings: appointing or removing personal representatives, resolving disputes over a surviving spouse’s elective share, and other administrative matters. When a caveat is filed and the will’s validity is put at issue, the case moves to Superior Court for trial. Understanding which court holds jurisdiction at each stage matters for strategy and timing.
