Grounds for Contesting a Will in North Carolina
A will caveat is North Carolina’s formal legal process for challenging whether a document is the decedent’s valid last will. Filing one puts the core question before the court: does this document genuinely represent the decedent’s wishes and meet the legal requirements for a valid will? The most common grounds fall into two categories.
Lack of Testamentary Capacity
To establish this, a challenger must show the testator didn’t understand who their heirs were, didn’t grasp the nature or extent of their property, didn’t understand what signing a will means, or didn’t recognize how the document would affect their estate.
Undue Influence
This means someone exerted pressure on the testator that overrode their free will, causing them to distribute property differently than they would have on their own. This often involves a caregiver, family member, or other person in a position of trust.
Other recognized grounds include improper execution (the will wasn’t signed or witnessed correctly), fraud, and the existence of a later valid will that supersedes the one admitted to probate.
How a Will Caveat Moves Through the Courts
A caveat is filed with the Clerk of Superior Court in the county where the will was probated. For Charlotte residents, that means the Mecklenburg County Courthouse, which manages probate filings for the area. Once filed, the clerk generally transfers the case to Superior Court, where a jury decides whether the challenged document is the decedent’s valid will. This proceeding is sometimes called a devisavit vel non, Latin for “he devised or not,” reflecting the core question put to the jury.
Not everyone can file a caveat. Only an interested person has standing: typically an heir who would inherit under intestacy (the rules governing estates without a valid will) or a beneficiary named in an earlier will. The deadline is generally three years after the will is admitted to probate in common form. Because filing a caveat generally pauses estate distributions while the matter is pending, timing matters from the moment you identify a concern.

Will litigation doesn’t always end in a jury trial. Many disputes between a propounder (the party defending the will) and a caveator (the party challenging it) are resolved through negotiation or estate mediation before the case reaches the courtroom.
